Charles Westis filed a suit in the circuit court of Lake county, charging that he was injured through the negligence of Barnett Aughinbaugh. The case was tried before a jury that rendered a verdict in favor of the plaintiff for $8,750. The defendant, Aughinbaugh, has perfected an appeal from that judgment to this court.
