Defendant was convicted of violating 26 U.S.C.A. § 2803(a) by having in his possession a gallon of distilled spirits in a container which did not have a stamp attached showing payment of Internal Revenue taxes.

On the basis of an alleged unreasonable search and seizure, an oral motion was made at the beginning of the trial, and renewed during the trial, to suppress Exhibit I, being the jug of distilled spirits. Each motion to suppress...
