At about nine o'clock A.M. on April 28, 1949 one Demaret, an employee of the Gulf Research & Development Co., was driving its 1941 model Studebaker automobile east along U. S. Highway 190 at approximately 50 miles as hour and following behind him was a Ford Sedan owned by Woodward Wight & Co., Ltd., and operated by its employee, Jack Herbert, and immediately behind this car, proceeding in the same direction,
