These two actions were instituted by plaintiff to recover certain sums of money alleged to have been paid to the defendant under protest for income taxes for the years 1948 and 1949, and were filed in due time after the alleged payment. They were heard at Asheville by the court without a jury, and by consent, after having been previously consolidated.
