This is an appeal from an order dismissing an action as barred by the statute of limitations. The action was instituted to recover damages for breach of an agreement by the terms of which the defendant Cohen purporting to act as president of the Suburban Park Stores Corporation, a corporation which did not in fact exist, agreed to erect a gasoline station on property which he did not own and lease it to plaintiff for a period of ten years beginning May...
