This is an action of the case in assumpsit brought to recover damages for the alleged breach of a contract. It was heard in the superior court on defendant's demurrer to plaintiff's second amended declaration. The trial justice sustained the demurrer on all grounds and the plaintiff has duly prosecuted his bill of exceptions to this court.
