CONWAY, J.

On December 21, 1950, plaintiff's husband, Louis C. Gross, while employed by Russell & Laurie, Inc., suffered injury arising out of and in the course of his employment through the negligence of the defendant, not his employer, and, died in consequence.

The decedent was survived by his wife and two adult children, Charles Gross and Edna Gross Brown, his married daughter.
