On May 24, 1949, the defendants Trott and Malone, residents of this Commonwealth and masters respectively of the fishing vessels "Edith" and "Elva and Estelle," were dragging with otter trawls approximately one and one half miles off the shores of Monomoy Island in the open sea when their vessels were boarded by a coastal warden of the department of conservation, division of marine fisheries, of the Commonwealth.
