The district attorney filed an information accusing Luis J. Leon and Jimmy Carroll of a violation of Penal Code, section 187, in that on August 8, 1953, they murdered Vincent M. Ortiz. The case was tried before a jury which returned a verdict finding both defendants guilty of murder in the first degree, and fixed the penalty at life imprisonment.
