The indictment charged defendant committed burglary of the dwelling house of Mrs. Eleanor Dill at 294 East 17th Street, in Des Moines, in the nighttime, with intent to commit larceny, and, after having entered such dwelling house, assaulted Mrs. Dill. Mrs. Dill testified she slept on a divan on the first floor of her house. Her two small children and her sister slept on the second floor. Her husband was in the army in Germany.
