This case is before us on a writ of error to a judgment entered upon the verdict of a jury convicting E. E. Slusher, sometimes hereinafter referred to as the defendant, upon an indictment which charged that he "did attempt to maliciously, unlawfully and feloniously assault, cut and wound one Thomas O.
