Under an indictment charging murder in the first degree, the defendant was convicted of manslaughter in the first degree and was sentenced to the penitentiary for a term of 9 years.

The evidence is undisputed that defendant shot her husband with a pistol on the 20th day of April, 1953, while he was standing in the front yard of their home. Deceased was taken to Mobile City Hospital the day he was shot and remained there until the latter part...
