CULVER, Justice.

Wichita County sought a declaratory judgment to test the constitutionality of Section 57, Article 1436-1, Penal Code,1 in so far as it allowed additional compensation to tax assessors-collectors in counties of a population of more than 20,000 and paid on a salary basis and to recover from the respondent assessor-collector the sum which had theretofore been paid to him under the provisions of this statute.
