Consideration has now been given to the motions for summary judgment and dismissal of the action filed by the defendants and to the briefs in support of and in opposition thereto. While it is doubtful that any extended discussion by this court of the questions posed can serve a very useful purpose, inasmuch as the genesis of the motions is said to be an opinion by the undersigned in Jones v. Goodman, D.C.,
