These are two actions of contract. The first is brought by Guleserian, hereinafter called the buyer, and the second, a cross action, is brought by the Pilgrim Trust Company, hereinafter called the seller. The buyer sought to recover $10,000 representing a $5,000 deposit on a contract to purchase real estate and a $5,000 deposit on a contract to purchase personal property.
