Appellant, a chain gang guard, was convicted of assault and battery with intent to kill and murder for the shotgun shooting of a prisoner. Immediately upon publication in the usual manner of the guilty verdict, appellant moved for a new trial upon the single ground that the evidence was insufficient to sustain the verdict. On the following day the motion was argued by counsel and denied by the trial judge who thereupon sentenced...
