Fabian Gonzales was fatally injured in an automobile accident while en route from Abilene to Olney, Texas, on the morning of October 22, 1951. Appellees, as his beneficiaries under the Texas Workmen's Compensation Statutes, Art. 8306 et seq., Vernon's Texas Civil Statutes, instituted this action to set aside an award of the Industrial Accident Board denying their claim for compensation.
