The plaintiff in error, Zahnie Z. Dunlap, hereinafter referred to as defendant, was charged in the municipal criminal court of the City of Tulsa with driving a motor vehicle upon a public highway while under the influence of intoxicating liquor. He waived trial by jury and was tried before the court, who found him guilty as charged and assessed punishment at a fine of $100 and costs.
