MAJOR, J.

This is a motion made by Thomas L. Havill for permission to file a late claim against the State of New York. The claim arose out of an accident at the New York State Fair Grounds on September 12, 1953, when a racing car went through or over the retaining wall around the race track.

The claimant, a student at the Syracuse University, was over twenty-one years of age at the time of the alleged accident. He did not file a notice of intention...
