The defendant Lee Pittman was charged by an information filed in the District Court of Custer County with the crime of assault and battery with intend to kill his wife, Inez Pittman; was tried, convicted and in accordance with the verdict of the jury was sentenced to serve five years imprisonment in the penitentiary and has appealed.
