This action arises from an automobile accident which occurred on the Newtown Road, approximately four miles north of Lexington, on the night of August 8, 1952, when an automobile being driven in a southerly direction by Paul Lyle Hood, Jr., collided head-on, near the center of the road, with an automobile being operated in a northerly direction by J.
