In the trial court appellant was charged by affidavit with assault and battery, on July 1st, 1953.

Omitting caption and verification, the affidavit is as follows:

"Carl Miller, being duly sworn on his oath, says that he is informed and verily believes that on or about the 27th day of June, 1953, at the county of Brown, State of Indiana, Paul Trisler did then and there unlawfully touch another, to wit: One Earl Miller, in a rude, insolent...
