1. In reviewing this case it is first necessary to decide whether the trial court had jurisdiction to entertain the adoption proceedings. The act of 1941 (Ga. L. 1941, p. 300), as embodied in Code (Ann. Supp.) § 74-401, provides in part that "The superior courts of the several counties shall have exclusive jurisdiction in all matters of adoption.
