BELIVEAU, Justice.

Proceedings as in equity authorized by Section 85, Chapter 5, Revised Statutes. These proceedings were instituted by the petitioner, Howard A. Miller, alleging that at a municipal election in Waterville on the first Monday of December 1953 he was duly elected a Member of the Board of Education. A hearing was had on this bill and the decision favored the respondent. An appeal from that decision is before this Court.
