BAKER, Justice.
This is an action of the case in assumpist to recover the purchase price of certain land because of the rescission of an alleged agreement which has been made by the parties. After a trial in the superior court a jury returned a verdict for the plaintiff for $1,431. The defendant's motion for a new trial was thereafter denied and he has prosecuted his bill of exception to this court.
