SWEPSTON, Justice.

The plaintiff in error was convicted of promoting gaming and his punishment fixed at a fine of $575 and a jail sentence of nine months.

It is assigned as error that there is no evidence to support the verdict and that the evidence preponderates in favor of the innocence of the plaintiff in error.
