Plaintiff appeals from an order denying his motion to set aside the verdict and grant a new trial.

On April 25, 1954, at 4:30 p.m., plaintiff was proceeding north on Seventeenth avenue southeast in Minneapolis, Minnesota. The weather was clear and the streets were dry.
