Harry Kor and one Kaufman were charged with violation of section 11500 of the Penal Code (unlawful possession of heroin). In a trial by jury both defendants were convicted. Kaufman's motion for a new trial was granted, and the cause was then called for immediate trial, trial by jury was waived, and the cause was submitted upon stipulation.
