STATE v. BARRETT

No. 79.

83 S.E.2d 480 (1954)

240 N.C. 600

STATE v. John William BARRETT, Defendant, and State-Wide Ball, Inc., Surety.

Supreme Court of North Carolina.

September 22, 1954.

Attorney(s) appearing for the Case

Charles L. Abernethy, Jr., New Bern, for appellant.

C. H. Leggett, Tarboro, for appellee.

PER CURIAM.

The facts in this case are substantially on all fours with the facts in State v. Dew, N.C., 83 S.E.2d 482, except that the surety in its answer alleges that the defendant was at the time of the judgment nisi in custody of officers of Hudson County, New Jersey, and the court granted a full hearing. What is said in the opinion in that case is controlling here.
