This action arose out of the construction of certain houses on lots owned by the defendants. In December, 1950, an "Owner-Contractor Agreement" was entered into by Myron B. Levi and C.M. Maaskant as "Owner" and Richard Goodenough, Robert Goodenough and Dick B. Williams as "Contractor," for the erection of houses on these lots.

This contract provided that the "Contractor" agreed to provide all labor...
