These cases arise out of a collision which occurred on September 6, 1951, between a Mercury automobile driven by Donald Engel in which plaintiff Robert Daly was riding as a guest passenger and a three-ton Dodge delivery truck driven by Richard Butler as an employee of Hans Rosacker Company.
