PER CURIAM.

Defendant Leonard Roe was indicted for the crime of operating a motor vehicle while in an intoxicated condition, third offense, in violation of section 321.281, Code of Iowa 1950, I.C.A. He pleaded not guilty, was tried, convicted and sentenced to the penitentiary at Fort Madison for an indeterminate period not to exceed three years. Defendant's appeal comes to us upon a clerk's transcript. We find no error. Accordingly the judgment is—
