A verdict was returned to the Huntington Circuit Court finding the appellant guilty of the second offense of operating a motor vehicle while under the influence of intoxicating liquor, and fixing his penalty at a fine of $100 and imprisonment at the Indiana State Farm for one year.

Judgment followed the verdict and this appeal followed the overruling of appellant's motion for new trial.
