Richard and Virginia Lucado were married August 25, 1940, and on April 25, 1943 their only child, Barbara, was born. On December 6, 1946 a decree of divorce was entered in favor of the plaintiff husband on the ground of desertion, and by stipulation he was given the care, custody and control of Barbara.
