This is an appeal from a judgment of conviction for the offense of assault with intent to murder. The person assaulted was Howard Woodfin.

When the case was called for trial the defendant's attorney presented a doctor's certificate which stipulated that the appellant was ill. Some doubt arose about the accuracy and merit of the claim.
