This appeal involves a second suit instituted in the circuit court of Prince William county, Virginia, by Oliver V. Kessler, hereinafter designated complainant, to determine whether he, as the surviving consort, is entitled to participate in the distribution of the estate of Rose Meredith Kessler. In the first suit he was denied this right on the ground that prior to Mrs. Kessler's death she had obtained a valid divorce from him in Florida...
