The Probate Court of Nodaway County, Missouri, wherein the claim was filed, disallowed the claim and plaintiff appealed to the Circuit Court. On application for a change of venue, the Circuit Court of Nodaway County sent the case to the Circuit Court of Harrison County. A jury was waived and the case was tried before V. C.
