PONDER, Justice.

We granted a review in this case because we were of the opinion that the Court of Appeal was in error in concluding, under the facts found by them, that the driver of the defendant's bus was not negligent in operating the bus at the rate of 45 miles per hour and that the Court of Appeal was in error in relying on the holding in the case of Anderson v. Bendily, 66 So.2d 355.
