HOLLAND, Justice.

Defendant in error James D. Kauffman, on February 20, 1950, entered into a written agreement for the purchase of 280 acres of irrigated land in Routt county from his father, Raymond C. Kauffman, now deceased. The purchase price was $5,600 payable $600 at the time of the execution of the agreement and the balance in five equal annual installments of $1,000 each, beginning February 20, 1951.
