This case is before us on plaintiffs' motion for judgment on the pleadings.

No substantial factual dispute exists. The pleadings disclose that on April 29, 1953, plaintiffs agreed in writing with defendant to sell him a certain house and lot of ground in Yeagertown, Pa., for which defendant agreed to pay $15,000, $1,500 of which was paid upon the execution of the memorandum of agreement and the balance of $13,500 was to be paid...
