Appellant by petition in trial court against Texas Housing Company and New Mexico Housing Company sought a recovery of damages for breach of an oral contract of employment allegedly entered into between Mitchell and Winfield Morten, President of the Texas concern. The New Mexico defendant was made a party on information and belief that there was either a merger of the two companies or that the latter had taken over the assets of the Texas Housing Company...
