On April 27, 1951, at about 9 p.m. plaintiff J. Harry Earley suffered very severe injuries by being struck by a car driven by Lewis J. Sutherby, and jointly owned with Loretta Sutherby, his wife, both defendants herein. According to the declaration, the accident occurred "near" the intersection of Ford avenue (also known as Northline avenue) and Lindbergh avenue in the outskirts of the city of Wyandotte, Michigan...
