Appellant was indicted for the murder of Harley Ware, age 16, tried before a jury, convicted of manslaughter, and sentenced to five years in the penitentiary. Deceased and witness Chambers went into the Tom Sawyer Cafe in Sunflower at about 10:00 P.M. on Saturday night.
