The sole question to be determined by the jury was whether the property settlement made between the parties at the time they entered into the separation agreement, which settlement was not reduced to writing, included a settlement of any and all liability on the part of the defendant to the plaintiff by reason of the execution and delivery of the aforesaid notes.
