Defendant was tried and convicted on October 17, 1952 in the Essex County Court before a judge and Jury on nine indictments tried together by consent. Six of these charged defendant with the crime of breaking, entering, larceny and receiving (hereinafter referred to as B.E.L. & R.); another charged malicious burning; still another charged possession of burglars' tools; and the last charged breaking and entering (B. & E.).
