The assignments of error brought forward by the plaintiff, and discussed in his brief, relate solely to the charge of the court on the first issue.

The trial court instructed the jury that the plaintiff alleges actionable negligence on defendant's part, and that consists of two elements: the first being negligence, and the other proximate cause. He then defined negligence in words unexcepted to by plaintiff, and followed it with this language...
