Plaintiff, Murdis Warren, fractured a bone in his foot. He consulted the defendant, Dr. Alfred Roos, a chiropodist. Dr. Roos placed a flexible cast on the foot. The fractured bone did not heal, the broken parts slipped, and surgery, by a different doctor, was required to rectify the condition.
