This is an action of tort for malicious prosecution of the plaintiff on a charge of larceny of an automobile. The action was tried to a judge and jury. At the close of the evidence the defendant moved for a directed verdict on the ground that the evidence did not warrant a finding of want of probable cause. This motion was denied by the judge who submitted the case to the jury under leave reserved. The jury found for the plaintiff and the judge denied...
