STATE v. BOLLING

No. 439.

81 S.E.2d 266 (1954)

240 N.C. 141

STATE v. BOLLING.

Supreme Court of North Carolina.

April 14, 1954.

Attorney(s) appearing for the Case

Harry McMullan, Atty. Gen., and T. W. Bruton, Asst. Atty. Gen., for the State.

Carl L. Gaddy, Jr., and George M. Anderson, Raleigh, for defendant-appellant.

PER CURIAM.

The charge of the court is not brought forward.

The sole assignment of error argued in the defendant's brief is the failure of the trial court to grant his motion for judgment of nonsuit aptly made.

The evidence, considered in the light most favorable to the State, is sufficient in our opinion to carry the case to the jury. State v. Smith, N.C., 81 S.E.2d 263
