Relator was indicted in Kings County on a charge of attempted robbery in the first degree on March 5, 1936, and entered a plea of not guilty. On May 13, 1936, the District Attorney surrendered relator to a United States Marshal to be prosecuted on an indictment for an unrelated Federal offense in the United States District Court for the Southern District of New York.
